Procedural Safeguards for Parents of Students with Disabilities
This notice of your procedural safeguards MUST be made available to you, at least one time a school year.
As a parent, you are entitled to information about your rights under the Individuals with Disabilities Education Act (IDEA). These rights, or procedural safeguards, are intended to ensure that you have the opportunity to be a partner in the educational decisions made regarding your child.
This information helps parents of children in Florida understand the rights that go along with programs for students with disabilities. It includes a description of the procedural safeguards that apply to students with disabilities enrolled in public schools and those that apply to students with disabilities enrolled by their parents in nonprofit private schools.
Parents who rights have been violated by a public school district regarding their student’s exceptional student education may be able to resolve those issues informally at the local level. However, administrative remedies (mediation, state complaint, and due process hearing request) are also available.

Guardianship
Guardianship: A guardian is someone who is given legal authority to care for and make decisions for another person. Guardianship removes an adult’s right to make decisions about the areas of his or her life that a court has decided the person is not competent to make their own decisions about. The law refers to a person for whom a guardian has been appointed as a “ward” of that guardian.
Each of Florida’s guardianship statutes require that even when a right has been taken from an individual and given to a guardian or guardian advocate, guardianship is still required, to the extent possible, to consider the individual’s wishes and to allow the individual to participate in decisions affecting their life.
Alternatives to Guardianship: Durable Power of Attorney | Living Will | Health Care Surrogate | Advanced Directives | Family and Friends

Understanding Autism Spectrum Disorder
Autism spectrum disorder is a developmental disorder marked by impaired social interaction, limited communication, behavioral challenges, and a limited range of activities and interests. It has been estimated to affected to one in 40 individuals in the United States and it is more common in boys than girls.
Treatment providers all over the country, who have been doing top-quality ABA treatment for individuals with autism for a minimum of 30 hours per week for two or more years, have been recovering individuals for years.
How to measure the need for Educational Supports and Services:
-
Does the student with an identified disability score in the Average, Low Average, At Risk, or Clinically Significant range on valid standardized tests of intelligence, language, socialization, and daily living skills?
-
Is the student with an identified disability earning passing grades in a regular education classroom, with no specialized supports?
-
Has the student with an identified disability been evaluated by a licensed Medical Physician or Psychologist specializing in diagnosing mental disorders (DSM-5-TR), and provided the recommendation of the student no longer qualifying for a mental health diagnosis?
